Information on the processing of personal data
- Data Controller
The Data Controller of your personal data as a Candidate for employment is Actona Poland sp. z o.o. with its registered office in Brodnica. - Data Protection Coordinator
A Data Protection Coordinator has been appointed at Actona Poland sp. z o.o., and can be contacted via email at: maciej.zoltowski@actonagroup.pl. - Purpose of Processing
We will process the Candidate’s personal data to conduct the recruitment process. - Legal Basis for Processing
The legal basis for processing the Candidate’s personal data is:- legal regulations (Article 221 § 1 and § 2 of the Labor Code) concerning the processing of data necessary for fulfilling the Employer’s rights and obligations during the recruitment stage, namely: name and surname, parents’ names, date of birth, place of residence (correspondence address), education, previous employment history, and other Candidate data if necessary due to the Candidate’s exercise of specific rights under labor law, as well as data contained in employment certificates from previous workplaces or other documents confirming employment periods, documents confirming professional qualifications required for the offered job, and other documents submitted to Actona Poland sp. z o.o. during the recruitment process if their submission is required by separate regulations; and
- Actona Poland sp. z o.o.’s legitimate interest in contact details provided in the CV and cover letter, data shared by the Candidate during the interview, or contained in a medical certificate confirming contraindications to work in a specific position; or
- consent for the use of other data provided by the Candidate in the CV and cover letter and for the use of the Candidate’s personal data in subsequent recruitment processes organized by the Controller.
Providing personal data by the Candidate is voluntary but necessary for fulfilling the purpose of processing specified in point 3 (i.e., conducting the recruitment process).
- Data Retention Period
We will retain the Candidate’s personal data:- if the Candidate is employed – for the duration of the employment relationship and for the mandatory period of retaining documentation related to the employment relationship and personal files, as determined by separate regulations;
- if the Candidate is not employed – for six months from the conclusion of the recruitment process for the position applied for, and if the Candidate consents to the processing of personal data in other recruitment processes – for one year.
- Data Recipients
The Candidate’s personal data may be transferred to the following entities:- our authorized employees,
- entities processing personal data on our behalf, including providers of electronic services and employment agencies,
- entities within the capital group to which our company belongs,
- entities providing property protection services to the Employer,
- public administrative bodies, including tax authorities and others,
– while the indicated persons/entities will process the data solely on the basis of legal regulations, agreements, or authorizations issued by us.
- Transfer of Data to Third Countries
Your personal data will not be transferred to recipients in countries outside the European Union (so-called third countries) during the recruitment stage. - Rights Related to Personal Data Processing
In connection with the processing of your personal data as a Candidate, you have the following rights:- the right to access personal data,
- the right to request rectification of personal data,
- the right to request deletion of personal data,
- the right to request restriction of personal data processing,
- the right to object to processing – in cases where we process your data based on our legitimate interest,
- the right to data portability, i.e., the right to receive your personal data from us in a structured, commonly used, machine-readable format and the right to request that we transfer this data to another controller,
- the right to withdraw consent for processing – insofar as your data is processed based on consent; you have the right to withdraw your consent at any time. Withdrawal of consent does not affect the legality of processing carried out on the basis of consent before its withdrawal. Withdrawing consent or requesting data deletion means withdrawing from further participation in recruitment processes at Actona Poland sp. z o.o. and will result in the immediate deletion of your data.
- the right to lodge a complaint with the supervisory authority responsible for personal data protection in Poland, i.e., the President of the Personal Data Protection Office.
